These Terms of Service ("Terms") govern your use of www.digiatorsconsulting.com and the services provided by Digiators Consulting Services ("we", "us", "our"). By using our website or engaging our services you agree to these Terms.
Our services
We provide software engineering, AI, cloud, data, quality engineering, recruitment and staffing, and related consulting services. The scope, deliverables, timelines and fees for each engagement are set out in a written proposal, statement of work or agreement signed by both parties. If those documents conflict with these Terms, they take priority.
Use of the website
- You agree to use the site lawfully and not to attempt to disrupt, scrape at scale, or gain unauthorised access to it.
- Information on the site is provided for general information and may change without notice. It is not professional advice for your specific situation.
Fees and payment
Fees, invoicing schedule and payment terms are agreed in writing for each engagement. Unless otherwise agreed, invoices are payable within 15 days of the invoice date. Late payments may incur interest and may lead to suspension of services. Taxes are charged where applicable.
Client responsibilities
You agree to provide timely access to information, systems, decisions and feedback needed for us to deliver. Delays on your side may affect timelines and costs.
Intellectual property
Unless agreed otherwise in writing, ownership of custom deliverables transfers to you upon full payment. We keep ownership of our pre-existing tools, frameworks, know-how and templates, and grant you a licence to use them as part of the deliverables. All content on this website, including text, logos and design, belongs to Digiators Consulting Services or its licensors.
Confidentiality
Each party agrees to keep the other's confidential information secure and use it only for the engagement. This does not apply to information that is public, already known, or required to be disclosed by law.
Recruitment and staffing
For recruitment and staffing services, candidate information is shared only for the purpose of the engagement. Placement fees, replacement guarantees and notice terms are set out in the applicable agreement. Candidates are not to be engaged outside the agreement during its terms.
Warranties and disclaimer
We perform services with reasonable skill and care. Except as expressly stated in a signed agreement, the website and services are provided "as is" without warranties of any kind, including fitness for a particular purpose or uninterrupted availability.
Limitation of liability
To the extent permitted by law, we are not liable for indirect, incidental or consequential losses, including lost profits or data. Our total liability for any claim is limited to the fees paid to us for the services giving rise to the claim in the three months before it arose.
Termination
Either party may end an engagement according to the notice terms in the agreement. You remain responsible for fees for work completed up to the termination date.
Governing law
These Terms are governed by the laws of India. Courts in Ahmedabad, Gujarat have jurisdiction over any dispute, unless another arrangement is agreed in a signed contract.
Changes to these Terms
We may update these Terms from time to time. Continued use of the site after changes means you accept the updated Terms.
